I have gotten some info from other mortgage people and have NOT had to pay a dime. That should come out of the Green Tree people

I am trying to get 2 months of payment that we did in Oct 2012 and Nov 0f 2012, To have a lien released. I shouldn't have to pay for this information that the FSA need to release a lien on our property.

DITECH needs to be investigated!!!!!!!!!!!!

Due to my own lack of attention to my escrow shortages and how Green Tree/DiTech has been managing them, after a few years it is now out of control and will take a forensic accountant to figure it out!!! What I do know is that they collect a "cushion" ever year that is equal to two months' escrow, however, every year, regardless of how little my insurance or taxes may increase, that cushion is gone and I STILL have a shortage.

and regardless of the fact that they do an "escrow analysis" to help me get a handle on any shortages...their escrow accounting (as you have said) is done to their OWN benefit and always early in the year before you have even had an opportunity to accumulate the needed balances!!! They sent me a letter stating my shortage and that I could either pay it in full OR my payments will increase by $80! I was told by the last of several representatives I have attempted to speak to about this....that they are not collecting a cushion AND a shortage. But they went into my escrow, applied the amount of "cushion" as a "deduction" which put me in the negative, THEN they repaid the "advance" by taking it from my next two escrow payments!!!!!!!!!

I am STILL being charged the $80 extra in my payment for the "shortage" , so if my shortage already includes my cushion, then why did they pay themselves and still increase my payment????? Also, if there is a cushion every single year and they are not using it for my "shortage"...why is it not still in my escrow account?? They also calculate the repayment of the shortage over a period of 27 months (if you will read the fine print)..however, every twelve months (or more) they do an analysis...so I have no idea...how the 27 month repayment plan works and where the money I did pay was applied ???????? That 27 month repayment plan is NOT doing you a favor!!!

I am going to write ONE LETTER TO THESE PEOPLE and if this is not resolved I am reporting them to the SEC!! They referred me to RESPA guidelines as to their right to collect their "cushion", but while I know this is done when you get a new loan, I could find nothing in RESPA about this....and it was not done with GreenTree...only DiTech.....If I could refi to another company I would in a minute! but I can't so I have decided to sell my home...the payments will be to high for me to keep it and I can't manage the stress this is causing me.

I have never missed a mortgage payment in my life and I won't allow this company to ruin my credit. If enough people complain IN WRITING maybe it will prompt an investigation!!!

Been thru pure *** with them now sold to shell point & trying.g to say we owe 6 grand! We didn't even know they bought us until 2 wks before they filed writ of possession!

I have the same problem Over 6000. In escrow shortages and never a straight answer.

Now as they see my mortgage to new Rez, they tell me I have to send them my detailed explanation as to why I should t have a shortage. This is after I have already submitted Written and verbal explanations. To have one year of an overage. Then a year of a shortage.

For over $6k?! My total escrow per year is under $5k. This is insane. Someone screwed up.

And I have to pay for it?

That’s why they went under. Anyone doing a class action?

I too have had my rate go up, up and up. Then a few years later they send me a refund.

but then in the same month they bump my payment. I have requested 3 times to have my PMI taken off. My loan to value is way over the 20% but no they wont due it. They did an appraisal back in 2017 that said my home value was about 150K I about fell off my chair.

If anyone and myself included could find a 3 story 2 bath, 3 bedroom house in our area for that we would snap it up in a heartbeat. You cant talk to the escrow dept. you can only wight to them. you get no help or explanation on why they came up with this or how to appeal.

also When I question the accounting of the escrow you get no replay. And as stated by others the math just doesn't add up.

Who the *** told you you could get a 27 month repayment plan on your negative escrow? It’s 12 months standard and longer if you’re extremely negative in escrow.

You do realize escrow (tax and insurance) is not billed and determined by the mortgage company, right?

You picked you insurance company yourself and you talk to your own county tax department about why your tax increased. RESPA has nothing to do with Ditech itself, all mortgage companies are supposed to follow those rules.

Don't contact the CFPB it will ultimately waste your time. You should use the power of the QWR and RESPA to resolve your requests and then sue them when they violate. Google RESPA violations and lawsuits.

They will ignore the QWL. I waited over 60 days & now it's been a year & (give or take) 60 days.

My QWL was sent 12/17/2016 & it was drawn up by an attorney. The response I got from Ditech was written on Green Thieves letterhead. lol. My response said I was "burdensome" & that they didn't have to send me copies of any of the original documents I requested AND have a right to.

You're correct about one thing for sure - these fat cats that we pay to protect our rights don't give one wet *** about the laws or our rights or anything. Their only concern is their big fat bribery check they receive to help these mortgage companies/servicers screw us over royally. To the post who said she was going to sell - best of luck to you. They will do everything in their power to screw up your sale.

Your buyers will become so frustrated with the run around you will lose buyer after buyer until they can foreclosure on you. I wish I had better news, but I have not found anyone to help. I've called lawyers from California to New Jersey & everywhere in between. Most of the attorneys represent the crooks - not the victims.

You need to contact the Consumer Financial Protection Bureau and make a complaint. Their website is under consumerfinance.gov.

They should be making sure their is a cushion in your escrow account. This is their way of trying to get you into foreclosure. Do they own your loan or are they servicing your loan? If you don't know call and ask who owns the loan.

I was a customer of Green Tree Servicing LLC which was a subsidiary of Ditech Financial. Green Tree Servicing in 2012 said they never received a payment and when my payment was due 3/1/2012 they billed me for April 2012 on 3/6/2012 when I had until the 15th to pay and I argued with them. The payment went through my account on 3/8/2012. Would they listen no.

I had no internet and no money for an attorney. I had to abandon my house for a rental when my credit score was still good. What they did was put my property taxes into escrow but not my homeowner's insurance. I had over $2300 in escrow as an overage They did a foreclosure on my house in 11/2012.

I got my credit report in 2016 over 4 years after the foreclosure. Ditech Financial reported it as repossessions until April 2013, not foreclosure and charged it off with the IRS. They left me in an open derogatory status on my credit reports for almost 5 years. I found the Consumer Financial Protection Bureau website and I have made complaints against Green Tree/Ditech Financial, Bank of America/Countrywide for a forged promissory note, and Northwest Trustee Services for incorrectly recording documents which made the foreclosure invalid.

Since January 23, 2017 Ditech Financial has changed my Equifax credit report 7 times, TranUnion, that I am aware of 4 times, and Experian 2 times. Make sure you check your credit reports to see what they are reporting. If enough people complain to the Consumer Financial Protection Bureau there may be another lawsuit against Ditech Financial LLC like there was against Green Tree Servicing LLC where the CFPB and the FTC collected $63 million dollars. It's called Ditech Financial LLC but it's the same people from Green Tree Servicing.

You should not have to be looking after your escrow account. Ditech Financial should be letting you know ahead of time that there will be a shortage and where your money is going. Don't believe a word they say. I also always wondered where my money went to.

At this point, I'm looking into retaining an attorney because of their fraudulent acts. I reported them to the IRS Criminal Investigation Unit and I'll see what happens. Also, look at the Consumer Affairs website to see the complaints against Ditech Financial.

Stay away from Ditech

This is the worst mortgage company I have ever dealt with in 30 years of paying mortgages. Terrible web site, terrible customer service, zero integrity.

I paid extra every 2 weeks and they put it in a side account instead of paying off my principal. When I asked them to recalculate my principal, they said I had to send a registered letter. No fax, no email. Get in the 21st century!!

Apparently you have to call to get extra payments applied to principal even though you indicate it on their web site by checking a box. Stay away. I am looking at refinancing just to get away.

They never ever have my insurance documents, escrow is always off, payments screwed up. TERRIBLE COMPANY!

Ditech has the most inefficient people working there its a wonder they all have jobs!!! They closed my account after receiving our insurance check that was much needed to rebuild our home that was burned!

The house was NOT a total loss.

They claimed they didn't receive the letter that was sent with the check....but yet another person said he had ot in his hands read the whole thing to me!!! Absolutely ridiculous!

Hazard Insurance SCAM ...

I've had to continually prove to them that I already have hazard insurance and it's been faxed over and over to them, and each time a rep says that they don't have it in their records; this includes supervisors and supposed "managers" ... My insurance company has had an ongoing correspondence for better part of a year.

The scam is this, if I'm already paying hazard insurance; Ditech's whims then states that I don't have "sufficient" coverage and then they proceed to increase my mortgage by including/adding hazard insurance to my bill. I've reviewed and gone over with my insurance company and they have confirmed more than once that I have adequate coverage.

My contract with this mortgage company clearly states that you only have to carry enough insurance to cover the amount that you owe to this company. Ditech placed forced insurance on my home in the amount of almost 3 times the amount that I owe this company which is clearly a breach of contract.

When I tried to discuss this with them I was told they had to get what they could get. I am now in foreclosure and I can't get any help from this stupid company.

Ditech bought my loan from Countrywide and insurance was included in my escrow account yet Ditech thinks they can charge me for insurance. Smells like a serious class action law suit to me!

My carport can't even be used because it's dripping primer all over the cars and they won't do anything about it unless I give them more money. I'm not ***, they will not get another cent from me.

Ditech services my current mortgage, so when I wanted to refinance they seemed like an easy choice. Well....they were so easy that they didn't bother to call me when they added .75 origination fee.

They didn't bother to call me when they determined that I should do a debt consolidation instead of a cash out. They didn't bother to respond to any of my inquiries over the past month that my file has "been in underwriting".

If you're looking for a lender who will bait you in with a great deal then completely change the terms without the simple courtesy of a phone call, Ditech's your company. My business will be going elsewhere.

My problem start when Ditch took over my mortgage from Pacific Union Bank on January 2016,I send my payments on time as scheduled I made the error of sending my payment before the due date they lost my payment destroy the check and claim I was late. This went on for the 11 months with this company Try calling over and over the problem continues .I finialy get copy's of all my payments that I made because of this problems I end up in the ER for problems with my healt as a result of their neglegancy Hoping to have this resolve

Green Tree Servicing did a non-judicial foreclosure on my home in 2012. They were a subsidiary of Ditech.

Ditech bought Green Tree. They did the same thing to me. Same people just under Ditech. I didn't get a copy of my credit report until 2017 in which they charged-off the amount illegally under the "power of sale" clause which shows under Ditech Financial LLC on my credit report.

I went to the courthouse 2017 and found out that Fannie Mae was actually the "investor" they will never claim to be an owner. I don't know if Ditech owns or services your loan. Ask them. Get a copy of your promissory note from Ditech and it will tell you when your payment is due and how much the late fee is.

Make sure it's your signature on the promissory note. When I got a copy of mine from Bank of America they sent the Name/Signature Affidavit with it and it someone forged my name. I just made a complaint against Bank of America who bought Countrywide regarding the note. I faxed Ditech twice in February asking for copies of all documents I am legally entitled to in the file.

Only thing I received was a NOD and a fake promissory note. Make a complaint to the Consumer Financial Protection Bureau. I made a complaint to them regarding Green Tree Servicing and Ditech Financial said they needed 60 days to investigate which actually gives them 3 1/2 months to figure out how to fix their mess. They started changing my credit reports and of course information they are reporting is wrong.

They left me in a derogatory status for almost 5 years. This will be another complaint to CFPB. You should also check your credit report to make sure they are not reporting your payments as being late.

What amazes me is that after what happened after the Green Tree lawsuit, they just changed names, the Federal Housing Financial Authority who regulates Fannie Mae, still allows Fannie Mae to use this company. I am reporting Green Tree and also includes Ditech regarding my credit report to every federal agency I can.

Poor customer service and unprofessional and rude customer service representatives

Not one representative on the same page. Each call to company is a nightmare over and over.

The supervisors are lazy and cant solve issues no better than the service rep. Lamont Young a supervisor does not respond to customers voicemails in timely manner and avoid all calls. I have been told you cant leave voicemails for him when I know you can. documentations of customers call are very poor job performance.

when ask to talk to higher managers other than shift supervisors you are told there are no managers to take the calls for complaints.

Sorry piece of *** company to do business with and would not recommend this company to a dog. All the shift supervisors I have dealt with should be demoted.

There was a lawsuit in which CFPB and the FTC won a $63 million dollar lawsuit for consumers. Ditech bought Green Tree. Same thing happened to me under Green Tree but my credit report is under Ditech which I just checked this year. Green Tree forced me into foreclosure by using threats in 2012.

I found out that they were only servicing the loan and that Fannie Mae was the "investor".

They don't follow Fannie Mae Guidelines and it's more profitable for them put you into foreclosure then to have you make payments. If enough people complain hopefully they will bring a lawsuit against Ditech.

I've strongly considered seeking a lawyer. I've set up payments multiple times.

A week later I receive a letter saying I owe and get hit with late fees. I try to call and it goes straight to "Eric Grays" voicemail. Who mind you, is extremely rude IF and only IF he ever returns a phone call. I've received other certified letters threating to take my home only to call and be told to disregard.

This company is one of the WORST companies I've had to deal with.

I did not choose DiTech, I was forced due to them buying GreenTree. We should be able to change mortgage lenders in this type of situation.

Contact the Consumer Financial Protection Bureau. Green Tree Servicing was a subsidiary of Ditech in 2012.

They forced me into foreclosure with threats. I didn't know about the lawsuit that the CFPB and the Feds won until this year. I have made a complaint against them even though it's almost 5 years old. Are they your servicer or owner of your loan.

Get a copy of your promissory note and it will tell you when your payment is due by and how much the late fee is and make sure it's your signature on the note!!! I recently got mine and it was a forged signature. I am making every complaint I can with every government agency possible because these companies don't care about the customer and never have. It is more profitable for them to force you into a foreclosure than to service your loan.

More than likely Fannie Mae or Freddie Mac is the owner of your loan. Ask Ditech who owns the loan if you don't know. Mine originated with Countrywide which Bank of America bought and then went to Green Tree. I had to find out for myself that none of these people owned my loan.

They were just a "loan servicer" for Fannie Mae.

The Federal Housing Financial Authority is the conservator for these GSE's. If enough people complain they will take action to stop it.

I would like to start a legal actions agains this company. My email address is ffbucci@***.com This company is scam, affecting people´s life everyday and we need to do something, they don´t apply payments to the account and have fraudulent administration of funds, also they don´t help to solve problems quickly on purpose to generate problems to the client.

I am willing to prepare out of charge court case. This people should be out of business not a FHA bank, is a shame that government support this fraud acts agains the people.

We need to take action and do something about it. I hope you contact me to get more people involve in this issue.

Please let me know if you are going to file a class action suit. They have jerked me around for a year about my modification saying they never got the papers which I know they did and just put me to foreclosure. They have not answered my calls in over a month

Ditech purchased my home loan; I paid off the loan early. During the 90 day period it was to be recorded, DiTech reported to the credit bureau a past due of 60 days which resulted in my credit score dropping 125 points. They're idiots....spoke with Haley on Nov 17, 2016 a Ditech rep and she agreed that it was fouled up , spoke with Coty on 12/16/2016 and he was a little rude , telling me i was wrong, i have paperwork saying in may 2016 account was up to date and in June 2016 account was 60 dates late, just when did the time between may and june become 60 day, i also have proof that they had accept my remaining escrow for balance of loan, again i repeat these people are real idiots

Ditech - Mortgage Review

Currently have a mortgage with ditech. Did not mortgage through ditech and would not deal with them again.

They added several hundred dollars to my property tax bill, and also decided to add flood insurance to my escrow without reason, because someone accidentally sent them a bill for it raising my mortgage up about $100 bucks a month, and then tried to tell me I had to pay it anyway because they added it to my escrow and issued payment already. 4 hours into calling them about it, and expenses on my end to send them the paperwork that they already had, my payment is back to accurate (maybe) at less money than my previous years payment. I've been hung up on about a half a dozen times, and have to threaten to sue to get any productive work out of them towards this issue. In additiom I had to call in 6 times in a row to not get hung up on, for them to accept my payment, as all other methods would only allow me to pay the incorrect amount.

Their billing department must smoke crack. Buyer beware.

If this continues with them, I am going to take legal action. If it going to cost me time and stress to not get swindled by them, then its about to start costing them more money than its worth to deal with me.

Let me tell you threatening to sue them won't do anything. They don't care.

Green Tree Servicing LLC was a subsidiary of Ditech in 2012. Ditech bought Green Tree. Green Tree did the same thing to me in 2012 and made threats. They sent me a bill on March 6, 2012, claiming they didn't receive payment when they put the payment through my checking account on March 8, 2012.

They put on my bill that I owed over $2,300. I was so fed up I didn't make a payment in April 2012, and decided to abandon my house May 5, 2012, because of their threats and I did not inform them. Continually being harassed by employees. They put me into a non-judicial foreclosure which went through in 2012.

I hadn't got my credit report until 2017. They did a charge-off which is illegal on a non-judicial foreclosure in California under the "power of sale" clause in the Deed of Trust. I made a complaint with the Consumer Financial Protection Bureau and Ditech said they needed 60 days to investigate after waiting the 15 days to get back to the CFPB. I had previously faxed them twice on January 5, 2017, for all documents I was legally entitled to and received a Notice of Default and my promissory note.

I suggest you get a copy of your promissory note which will show you when your payment is due by and much a late charge is. Make sure it is your signature on the promissory note!!! When I got a copy of mine from Bank of America who bought Countrywide Bank, an angel from Bank of America actually sent the Name/Affidavit Signature that was notarized when I signed it. The signature on my note was forged.

I filed another complaint with the CFPB regarding the promissory note because Bank of America would not take responsibility. I was told because they bought the company they are not responsible for a forged signature. I also found out from my promissory note during the foreclosure process they were overcharging on the late fee. I found out by courthouse papers that Fannie Mae was the "investor" on my Trustee's Deed Upon Sale.

Fannie Mae allowed Green Tree to use a foreclosure company who were and are not now even attorneys. When I made a complaint to the CFPB it also included a complaint against the foreclosing company in which I questioned the recorded assignments they had done. The foreclosure company never recorded an assignment of Substitute Trustee and they will not respond to the CFPB. The CFPB informed me that they are sending my complaint to the Federal Trade Commission.

This tells me there is definitely a problem which may actually void the foreclosure which the current owner may not legally own the house. If Ditech is servicing your loan it is more profitable for them to foreclose than to service it. The bank lender doesn't tell you they sold your loan to a government entity. Green Tree pissed me off so badly that I went through and researched the whole process.

The whole mortgage industry is a farce. The Federal Housing Financial Authority is the conservator for, in my case Fannie Mae, for GSE's. If your loan is owned by an entity such as Fannie Mae or Freddie Mac they have guidelines that the servicers are supposed to follow. In my case, Green Tree chose not to follow Fannie Mae Guidelines.

Since my complaint to the CFPB, Ditech Financial started changing my credit reports. Of course their doing it incorrectly which will be another complaint to the CFPB.

I am reporting them to every government agency I can. If enough people complain to the Consumer Financial Protection Bureau they may be held accountable for what they are doing to consumers.

Ditech - Account Review

Online account is not accurate. As of 12-19-2016 it shows payment due on 7-01-2016 in the amount of $6117.13 with $7062.75 in unapplied funds and a $76.51 late fee.

I have been paying biweekly ever since Bank America,Country Wide,GreenTree and now Ditech has had my loan.

Never late. Any suggestions?

Ditech does not work well with split payments. The situation you describe is due to your split payments.

If you can schedule your split payments within your Ditech account 15 day window of payment without penalty, you can break the Unapplied Funds merry-go-round. Have Ditech CS send you an account statement regarding your Unapplied Funds and your mortgage repayment status to give your real estate attorney (get one!) about getting your mortgage back on track.

My loan was originally with Countrywide which Bank of America bought and then went to Green Tree Servicing. I ended up in a non-judicial foreclosure due to their threats.

I got my credit report after 5 years and they charged-off the foreclosure. In California in a non-judicial foreclosure under the "power of sale" clause they are not allowed to charge-off there is no deficiency. Green Tree was a subsidiary of Ditech in 2012 which then bought Green Tree. My credit report is shown as being reported under Ditech Financial LLC.

I was so angry I researched the process. I thought Green Tree was the owner of the loan but in recorded documents for the foreclosure I found out it was Fannie Mae. Make a complaint to the Consumer Financial Protection Bureau. It is more profitable for them to foreclose on your property than it is to service it.

I made a complaint to the CFPB against Green Tree and the foreclosure company for not recording the right documents during the foreclosure. Green Tree/Ditech is investigating my complaint and the foreclosure company will not respond to the complaint so the CFPB is sending my complaint to the Federal Trade Commission. Ask them who the owner of your loan is. Get a copy of your promissory note and Deed of Trust.

The promissory note will tell you when your payments are due by and how much the late fee is. When I got my promissory note and Signature/Name Affidavit from Bank of America/Countrywide I just found out the note is forged and Bank of America says they are not responsible because they bought Countrywide. I made another complaint to the CFPB about the promissory note. In courthouse records, I found out Fannie Mae was the beneficiary on the Trustee's Deed Upon Sale.

The lender never tells you they sold it to a government entity who puts it into a trust. More than likely, none of these companies are the owner of your loan they are the servicer. They have to follow the guidelines of the government entity which Federal Housing Financial Authority (FHFA) is the conservator for these entities. If enough people make complaints to the Consumer Financial Protection Bureau (consumer.gov) they will sit up and take notice and possibly bring a lawsuit against them like they did with Green Tree.

I did not find out about the lawsuit until this year. Go to the Consumer Affair website and read everyone's complaints about Ditech.

I can't post any reviews on the website because I am not a current client of Ditech. Please write a review and inform people as to what they should do.

We had greentree as well, they sold our loan to DITECH and since day one, nothing but problems. We refinanced on Nov.

1st, 2016 with another lender.

We are still waiting for a $3,900.00 refund from Ditech, every time I call it is a different story! I hate those ignorant fools!!!!!!!!

I inherent a mortgage with ditech after the flood the insurance company wrote check to me and ditech i sent all paperwork from clerk of court giving me full athrozition of the mobile home ditech refuses to except the paperwork they are saying i have to refinance the mortgage with only 13k to pay off i have a attorney try to.call them was told have to talk to legal department ok well the problem is they say they have no phone number to.contact them also i asked of i was to pay off in full how much i was told paying off early i would have to pay over 2k more make no sense my paper work said no pay off penalty this company is horrible never can get a stright answer i dont understand how this company has so many complaints and nothing can be done well i did receive a 10 check from the suit with greentree what a joke i have so much against greentree/ditech just to much to write over 20 years of mishandling from payment / interest /insurance i hope some attorney would open a other class action against them to help solve all these issue
